Welcome to Sand Capital. These Terms of Service ("Terms") govern your access to and use of the Sand Capital website, platform, investment services, affiliate program, and related services (collectively, the "Platform").
By creating an account, accessing the Platform, making a deposit, purchasing an investment plan, participating in the affiliate program, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the Platform.
For purposes of these Terms:
"Sand Capital," "we," "us," or "our" refers to the operator of the Sand Capital Platform.
"User," "you," or "your" refers to any individual or entity accessing or using the Platform.
"Account" means a registered user account on the Platform.
"Investment Plan" means an investment product or plan made available through the Platform.
"Deposit" means funds transferred by a User to the Platform for participation in an Investment Plan or other permitted Platform activity.
"Withdrawal" means a request by a User to transfer an eligible balance from the Platform to an approved withdrawal destination.
"Affiliate Program" means the referral and commission program operated by Sand Capital.
"Affiliate" means a User who participates in the Affiliate Program.
To use the Platform, you must:
Be at least 18 years old, or the minimum legal age required in your jurisdiction.
Have the legal capacity to enter into a binding agreement.
Provide accurate and complete registration information.
Comply with all applicable laws and regulations in your jurisdiction.
Not be prohibited from using investment, cryptocurrency, financial, or similar services under applicable law.
You are responsible for determining whether using the Platform is legally permitted in your country or jurisdiction.
Sand Capital may restrict or refuse access to Users from certain countries, regions, or jurisdictions where providing our services is prohibited or restricted.
Each User may maintain one account only, unless Sand Capital expressly authorizes otherwise in writing.
You agree to:
Provide truthful and accurate information.
Keep your account information current.
Maintain the confidentiality of your password and account credentials.
Take reasonable steps to protect your account from unauthorized access.
Immediately notify Sand Capital if you believe your account has been compromised.
You are responsible for activity conducted through your account unless you can demonstrate that the activity occurred without your authorization and through no fault of your own.
Sand Capital reserves the right to suspend, restrict, or terminate accounts that contain inaccurate information, violate these Terms, or present security, fraud, compliance, or operational risks.
Sand Capital may offer different Investment Plans with varying minimum amounts, maximum amounts, durations, and return structures.
The specific terms applicable to an Investment Plan will be displayed on the Platform at the time of purchase.
Before participating in any Investment Plan, you should carefully review:
Minimum and maximum investment amounts.
Investment duration.
Applicable returns or interest.
Maturity conditions.
Withdrawal conditions.
Any applicable fees.
Any other conditions displayed for the selected plan.
Investment availability may change at any time.
Sand Capital reserves the right to introduce, modify, suspend, or discontinue Investment Plans subject to applicable law and the rights of Users with existing active investments.
All investments involve risk.
You acknowledge that past performance, advertised rates, projected returns, or previous results do not guarantee future performance.
You should only commit funds that you can afford to lose and should independently evaluate the risks associated with digital assets, cryptocurrency transactions, investment products, and the Platform.
Nothing on the Platform should be interpreted as a guarantee that you will achieve a particular financial outcome.
The Platform may accept deposits and process certain transactions using supported cryptocurrencies or digital assets.
You are responsible for ensuring that:
You send the correct cryptocurrency.
You use the correct network.
You send funds to the correct wallet address.
You include any required transaction information.
You pay any applicable blockchain/network fees.
Cryptocurrency transactions may be irreversible once confirmed on a blockchain.
Sand Capital is not responsible for losses resulting from an incorrect wallet address, unsupported cryptocurrency, incorrect blockchain network, user error, or other transaction errors caused by the User.
Transaction confirmation times may vary depending on blockchain congestion, network conditions, wallet providers, and other external factors.
Deposits must be made using the payment methods and supported assets displayed by Sand Capital.
A deposit will only be credited after the applicable transaction has been successfully received and sufficiently confirmed.
Sand Capital may delay, reject, or investigate transactions where reasonably necessary for security, fraud prevention, compliance, technical, or operational reasons.
We may request additional information before crediting or releasing funds where required for verification or compliance purposes.
Unless otherwise stated on the Platform:
Each User may maintain only one registered account.
Each User may have a maximum of two active investments at the same time.
Sand Capital may establish additional limits, restrictions, or eligibility requirements to protect the stability and security of the Platform.
Attempting to circumvent investment limits by creating multiple accounts or using another person's account is prohibited.
Users may request withdrawals of eligible balances through the withdrawal methods supported by Sand Capital.
Unless otherwise stated for a particular plan or balance:
Users may submit one withdrawal request per week.
Withdrawal requests are subject to applicable processing procedures.
Minimum withdrawal amounts may apply.
Network or processing fees may apply.
Additional verification may be required before a withdrawal is processed.
A withdrawal request does not guarantee immediate processing.
Processing times may vary because of blockchain confirmations, security reviews, technical conditions, liquidity management, compliance requirements, or other operational circumstances.
Sand Capital reserves the right to temporarily delay a withdrawal when there is a legitimate security, fraud, compliance, or technical reason to do so.
Applicable fees, if any, will be displayed on the Platform or otherwise communicated to Users.
Fees may include, where applicable:
Blockchain/network transaction fees.
Withdrawal processing fees.
Service fees.
Other transaction-related charges.
Sand Capital may change applicable fees by providing appropriate notice where required by law.
Sand Capital may offer an Affiliate Program allowing eligible Users to receive commissions for qualifying activity generated through their referral network.
Commission structures, percentages, qualifying conditions, levels, and eligibility requirements are determined by Sand Capital and may be displayed on the Platform.
Affiliate commissions are subject to the applicable Affiliate Program rules.
Sand Capital may modify, suspend, or discontinue the Affiliate Program or individual commission structures subject to applicable law and any applicable rights that have already accrued.
Affiliates must promote Sand Capital honestly and responsibly.
Affiliates must not:
Make false or misleading claims.
Guarantee profits or investment returns.
Misrepresent Sand Capital's services.
Use deceptive advertising.
Engage in spam.
Create fake accounts or referrals.
Use fraudulent traffic or automated referral activity.
Impersonate Sand Capital or its representatives.
Make claims that Sand Capital is licensed, regulated, guaranteed, insured, or endorsed when such claims are not authorized and accurate.
Use Sand Capital's branding in a misleading manner.
Engage in unlawful marketing practices.
Sand Capital may cancel commissions generated through fraud, abuse, manipulation, self-referrals, duplicate accounts, or other prohibited activity.
You agree not to use the Platform for:
Fraud or attempted fraud.
Money laundering or terrorist financing.
Theft or unauthorized access.
Identity theft or impersonation.
Market manipulation or other unlawful financial activity.
Creating duplicate accounts to circumvent Platform rules.
Exploiting technical vulnerabilities.
Using automated systems to abuse the Platform.
Introducing malware, viruses, or malicious code.
Interfering with the operation or security of the Platform.
Conduct that violates applicable laws or regulations.
Any activity that could reasonably cause significant harm to Sand Capital, its Users, or its service providers.
Sand Capital may suspend or terminate accounts associated with prohibited activity.
Sand Capital may implement identity verification, transaction monitoring, fraud prevention, sanctions screening, or other compliance procedures where appropriate or required.
Users agree to provide accurate information and cooperate with reasonable verification requests.
Failure to provide requested information may result in restrictions on account activity, including deposits, investments, withdrawals, or access to certain Platform features.
Sand Capital may suspend, restrict, or terminate an account where we reasonably believe that:
These Terms have been violated.
The account is being used fraudulently.
The User has provided false information.
The account presents a security or compliance risk.
The User is attempting to circumvent Platform restrictions.
The User's activity violates applicable law.
The account is associated with suspicious or unauthorized activity.
Where legally and operationally possible, Sand Capital may provide notice of account restrictions.
Termination does not automatically eliminate obligations or liabilities that arose before termination.
We aim to maintain reliable Platform availability but do not guarantee uninterrupted or error-free operation.
The Platform may occasionally be unavailable because of:
Maintenance.
Software updates.
Security measures.
Blockchain network issues.
Hosting or infrastructure problems.
Cybersecurity incidents.
Third-party service interruptions.
Force majeure events.
Other circumstances outside our reasonable control.
We will make reasonable efforts to restore affected services as soon as practicable.
The Platform may rely on third-party services, including cryptocurrency networks, wallet providers, hosting providers, payment services, analytics services, communication providers, and other technology providers.
Sand Capital is not responsible for failures, delays, interruptions, or losses caused by third-party services outside our reasonable control.
Third-party services may have their own terms and privacy policies.
Unless otherwise stated, the Platform and its contents, including its branding, logos, graphics, text, software, design, and other materials, are owned by or licensed to Sand Capital.
You may not reproduce, distribute, modify, sell, publish, reverse engineer, or commercially exploit Platform content without prior written authorization.
Use of Sand Capital's trademarks, branding, or promotional materials must comply with our applicable brand and affiliate guidelines.
If you submit reviews, comments, testimonials, promotional content, images, or other materials to Sand Capital, you represent that you have the right to submit that content.
You must not submit content that is unlawful, fraudulent, defamatory, misleading, infringing, abusive, or otherwise prohibited.
Sand Capital reserves the right to remove content that violates these Terms or applicable law.
Your use of the Platform is also subject to our Privacy Policy.
By using the Platform, you acknowledge that information may be collected, processed, stored, and used as described in the applicable Privacy Policy.
By creating an account, you agree that Sand Capital may communicate with you regarding:
Account activity.
Transactions.
Security.
Investment activity.
Withdrawals.
Platform updates.
Policy changes.
Important service announcements.
Marketing communications may be subject to applicable consent and opt-out requirements.
We aim to provide accurate and current information on the Platform. However, information may occasionally contain errors, omissions, delays, or inaccuracies.
You should not rely solely on information displayed on the Platform when making significant financial decisions.
Sand Capital reserves the right to correct errors and update information when appropriate.
Information provided through the Platform is for general informational purposes and does not constitute personalized financial, investment, tax, accounting, or legal advice.
You are responsible for obtaining independent professional advice where appropriate.
You are solely responsible for determining and satisfying any tax obligations arising from your use of the Platform, including income, investment, cryptocurrency, affiliate, or other applicable taxes.
Sand Capital does not provide tax advice.
To the maximum extent permitted by applicable law, Sand Capital and its officers, directors, employees, contractors, affiliates, and service providers shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Platform.
This may include losses resulting from:
Cryptocurrency price movements.
Blockchain failures or delays.
Unauthorized access caused by User negligence.
Incorrect transaction information.
Third-party service failures.
Internet or infrastructure failures.
Regulatory changes.
Cybersecurity incidents.
Force majeure events.
Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.
To the maximum extent permitted by law, you agree to indemnify and hold harmless Sand Capital and its officers, directors, employees, contractors, affiliates, and service providers from claims, losses, damages, liabilities, costs, and expenses arising from:
Your violation of these Terms.
Your misuse of the Platform.
Your violation of applicable law.
Fraudulent or unauthorized activity associated with your account.
Your violation of the rights of another person or entity.
Sand Capital may update these Terms from time to time.
Updated Terms will be published on the Platform with a revised "Last Updated" date.
Where required by applicable law, material changes will be communicated to Users through appropriate means.
Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the revised Terms, to the extent permitted by law.
These Terms shall be governed by and interpreted according to the laws applicable to the legal entity operating Sand Capital, subject to any mandatory consumer protection or other applicable laws in your jurisdiction.
Any dispute resolution provisions should be interpreted consistently with applicable law.
Important: The specific governing law, jurisdiction, arbitration provisions, and legal entity information should be completed after the legal entity and operating jurisdiction of Sand Capital have been confirmed.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be limited or removed to the minimum extent necessary, while the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy and any other policies expressly incorporated into them, constitute the agreement between you and Sand Capital concerning your use of the Platform.
By using Sand Capital, you acknowledge that you have read and understood these Terms of Service and agree to comply with them.
